Terms and Conditions

The general terms and conditions of Embody and Flow apply to all events, sessions, retreats and products (digital and physical).

Personal Health and Safety Responsibility

Our events, sessions and retreats are generally safe and suitable for everyone.

Prior to booking, participants agree to discuss with their medical practitioner any physical or mental/psychiatric conditions or concerns that may present challenges or a risk to themselves or others during their session or event.

Clients also agree to disclose any health concerns with the facilitator/practitioner before the commencement of an event or session.

Due to health concerns, if you experience any of the following conditions we would not recommend taking part in our events, sessions and retreats.

  • People with cardiac pacemakers, artificial valves or cardiac arrhythmia

  • Pregnancy (especially the first trimester)

  • Post-surgery (less than 3 months)

  • Severe/critical diseases or infections if it impairs your ability to breathe

  • Severe uncontrolled hypertension (usually after a heart attack)

  • Organ failure or late-stage terminal illness

  • Epilepsy, a pacemaker, or irregular heart beat (Exception: your doctor gives you specific written permission).

All Embody and Flow offerings (services and products) do not replace medical therapy, or offer any healing treatment or promise to cure.

Events, Sessions, Retreats, Products and Gift Vouchers

Any events, sessions, retreats purchased are not transferrable to another person unless agreed by Embody and Flow.

Gift Vouchers are valid for 12 months from the date of issue.

Event and Retreat Organisation and Implementation

In order to conduct our events and retreats effectively, Embody and Flow has set a minimum and maximum number of participants. In case of an insufficient number of participants, the event or retreat will not be run. If this occurs, participants will be informed prior to commencement. For an event (24 hours notice will be provided) or retreat (7 days notice will be provided). Please be sure to include your current email and phone number so we can contact you regarding any cancellation or change.

If Embody and Flow cancels an event the purchase will be fully refunded to the participant.

In the case of a retreat cancellation, please refer to the specified retreat information provided (as accommodation and retreat centres incur different cancellation fees which must be adhered to).

Embody and Flow reserves the right to change the dates or cancel an event or retreat if for important reasons they cannot be run.

Payment Terms

All events and sessions must be paid for at the time of booking.

Retreat payment terms will be outlined in the individual retreat Terms and Conditions policy. A non-refundable deposit will be charged at time of booking.

Cancellation Provisions

All events have a 24 hour cancellation policy. Tickets are non refundable, however, they can be transferred to a future event (valid for 3 months) if you provide 24 hours' notice.

A session cancellation or rebooking within 24 hours of your appointment time will incur a fee. Cancellation fees within 24 hours is 50% of the booking and rescheduling within 24 hours incurs a $10 fee.

Illness and Accident

In the unfortunate case of illness or accident related no-shows/cancellations supported by a medical certificate, an event ticket can be transferred to a future event (valid for 3 months), a session can be rescheduled to a later date (valid for 6 months), and for retreat cancellations please refer to the retreat Terms and Conditions policy.

Waiver

Your participation in any event, session or retreat facilitated by Embody and Flow is at your own risk and responsibility. All participants accept full responsibility for any injury, loss or damage to themselves or their property, and waive all rights to prosecute and/or claim for damages against Embody and Flow.

Insurance

Embody and Flow assumes no liability for injuries/accidents and/or damage occurring during events, sessions and retreats. Each participating individual is personally responsible for having adequate insurance and medical coverage.

It is essential that all participants attending overseas retreats hold appropriate travel insurance to cover all retreat activities and offerings.

Photo and Video Recording

Participants are not permitted to photograph, make video or audio recordings during events, sessions or retreats unless approved by Embody and Flow.

You agree and understand the event or retreat may be filmed, photographed and/or recorded and that Embody and Flow shall have all rights in and to such film, photographs and/or recording, including the copyright therein. The copyright shall include, but not be limited to, the right to use, re-use, publish, and re-publish and otherwise reproduce, modify, and display any such film, photograph and/or recording for educational and promotional purposes. You grant Embody and Flow, the right, without compensation to you, to film, photograph and/or record you while participating in the event or retreat and you waive any right which you now have or may have hereafter in any such film, photograph and/or recording.

Product Returns

Due to the non-returnable nature of digital goods, Embody and Flow does not offer refunds once the product is purchased, downloaded or accessed.

Customers who submit complaints will be contacted within 5 business days.

We will endeavour to find an amicable solution as soon as possible, as we deeply value our clients and business.

The protection of privacy in the processing of personal data is a top priority for Embody and Flow. Personal data will be processed according to legal regulations.

Embody and Flow is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.

What is Personal Information and why do we collect it?
Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect includes names, addresses, email addresses and phone numbers.

This Personal Information is obtained generally via our website www.embodyandflow.com

We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Sensitive Information
Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.
Sensitive information will be used by us only:

  • For the primary purpose for which it was obtained

  • For a secondary purpose that is directly related to the primary purpose

  • With your consent; or where required or authorised by law.​

Disclosure of Personal Information
No data will be passed on to third parties. Exceptions to this are authorities, such as the tax administration/medical professionals, which has a legitimate claim to certain data.

​Security of Personal Information
Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us via email.
Embody and Flow will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.
In order to protect your Personal Information we may require identification from you before releasing the requested information.

Copyright and Intellectual Property

All products and course content are protected under Australian and International copyright and intellectual property laws. These materials and resources are intended for personal use by the purchaser/participant only and may not be copied, reproduced, shared, published or distributed in any form without prior written permission.

Unauthorised use may result in immediate legal action.
